1. Acceptance of Terms

By accessing or using HomeCalendar at webettermove.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and HomeCalendar ("we," "our," or "us"). Please read them carefully.

By using HomeCalendar, you acknowledge that you:

  • Are at least 13 years of age
  • Have read and understood these Terms
  • Agree to be bound by these Terms
  • Have the authority to enter into this agreement

If you are using HomeCalendar on behalf of a family or household, you represent that you have the authority to bind all family members to these Terms.

2. Description of Service

What HomeCalendar Provides

HomeCalendar is a family calendar coordination application that:

  • Syncs with Google Calendar to display your events alongside your family members' events
  • Creates unified calendar views for your entire family
  • Enables event creation that syncs back to Google Calendar
  • Provides a kitchen display mode for shared household tablets
  • Sends reminders and notifications for upcoming events
  • Detects scheduling conflicts among family members
  • Allows family announcements on the display view

Service Availability

  • HomeCalendar is provided as a web-based application accessible through modern web browsers
  • The Service is designed to work on desktop computers, mobile devices, and tablets
  • Some features may require JavaScript and cookies to be enabled
  • Internet connectivity is required to use the Service

Third-Party Integrations

HomeCalendar integrates with third-party services, including Google Calendar API for calendar synchronization, AWS Cognito for user authentication, and payment processors for subscription billing. Your use of these third-party services is subject to their respective terms and privacy policies.

3. User Accounts and Registration

Account Creation

To use HomeCalendar, you must:

  1. Create an account using a valid email address or Google Sign-In
  2. Verify your email address (if registering with email/password)
  3. Provide accurate information during registration
  4. Keep your account credentials secure

Account Responsibilities

You are responsible for:

  • Maintaining confidentiality of your account password
  • All activities that occur under your account
  • Notifying us immediately if you suspect unauthorized access
  • Keeping your contact information up to date

Account Security

You agree to:

  • Use a strong, unique password for your HomeCalendar account
  • Not share your account credentials with others
  • Log out of your account when using shared devices
  • Enable additional security measures when available (e.g., two-factor authentication)

4. Family Account Management

Family Structure

HomeCalendar uses a "family" model to organize users:

  • Each family can have up to 8 members
  • Family admins (typically parents) have full management privileges
  • Family members have access based on their assigned role

Family Admin Responsibilities

If you are a family admin, you:

  • Control who joins your family by sending invitations
  • Manage family member roles and permissions
  • Are responsible for the actions of members you invite
  • Can remove members from the family at any time
  • May set a family PIN for kitchen display security

Multi-User Consent

By adding family members to HomeCalendar:

  • You confirm that you have obtained consent from all adult family members
  • For minors, the parent or legal guardian adding them consents on their behalf
  • All family members agree that their calendar events may be visible to other family members

5. Subscription and Billing

Prices are in USD and may be subject to applicable taxes.

Free Trial

  • Trial period: 14 days from account creation
  • Payment method required: A valid credit card is required to start the trial
  • No charge during trial: You will not be charged during the 14-day trial period
  • Cancel anytime: If you cancel before day 15, you will not be charged
  • Automatic billing: If you do not cancel, your subscription will begin automatically

Payment Terms

  • Payment methods: We accept major credit cards and debit cards
  • Billing date: Your subscription renews on the same day each billing period
  • Failed payments: If payment fails, we will attempt to charge your card again and may suspend your account
  • Currency: All prices are in US Dollars (USD)

Price Changes

We may change subscription prices at any time. If we change prices, we will notify you at least 30 days before the new price takes effect. The new price will apply to your next billing cycle after the notice period. You may cancel before the price change takes effect.

6. Cancellation and Refunds

How to Cancel

You can cancel your subscription at any time:

  1. Go to Settings > Subscription > Cancel Subscription
  2. Confirm your cancellation
  3. You will receive an email confirming your cancellation

What Happens When You Cancel

  • Access continues: You retain full access to HomeCalendar until the end of your current billing period
  • No partial refunds: We do not provide refunds for partial billing periods
  • Data retention: Your data remains intact; you can resubscribe to restore access
  • Data deletion: After 90 days of an inactive (unpaid) account, your data may be scheduled for deletion

Refund Policy

Trial period: If you cancel during the 14-day free trial, you will not be charged.

Paid subscriptions:

  • Monthly subscribers: No refunds for monthly subscriptions. You retain access until the end of the paid month.
  • Annual subscribers: May request a pro-rated refund within the first 30 days of an annual subscription. After 30 days, no refunds are provided.

How to request a refund: Contact support@webettermove.com with your account email, reason for refund request, and date of purchase. We will review requests and respond within 5 business days.

7. User Responsibilities and Conduct

Acceptable Use

You agree to use HomeCalendar only for lawful purposes and in accordance with these Terms. You may:

  • Create and manage family calendar events
  • Sync your personal Google Calendar
  • Share calendar information with invited family members
  • Use the kitchen display feature in your home

Prohibited Conduct

You agree NOT to:

Misuse the Service:

  • Access or attempt to access accounts that do not belong to you
  • Share your account credentials with non-family members
  • Use the Service for commercial purposes without our consent
  • Create multiple accounts to abuse the free trial

Harm Others:

  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Upload content that is defamatory, obscene, or illegal
  • Use the Service to violate any applicable law

Harm the Service:

  • Interfere with or disrupt the Service or servers
  • Attempt to bypass security measures
  • Use automated scripts to access the Service without permission
  • Reverse engineer, decompile, or disassemble the Service
  • Introduce malware, viruses, or other malicious code

8. Calendar Data Ownership

Your Data Remains Yours

You retain ownership of all calendar data you create or import into HomeCalendar, including event titles, descriptions, dates, times, family member profiles you create, announcements you post, and settings and preferences.

License to HomeCalendar

By using the Service, you grant HomeCalendar a limited, non-exclusive, royalty-free license to:

  • Store your data on our servers
  • Display your data to you and your family members
  • Process your data to provide the Service features
  • Create backups of your data for disaster recovery

This license exists solely to provide the Service and terminates when you delete your account.

Data Portability

You may request an export of your data at any time by contacting support@webettermove.com.

9. Third-Party Calendar Integration Terms

Google Calendar Integration

HomeCalendar integrates with Google Calendar through Google's API. By connecting your Google Calendar:

  • You authorize HomeCalendar to access your calendar data as described in our Privacy Policy
  • You agree to comply with Google's Terms of Service
  • You understand that Google may change or discontinue their API, which could affect HomeCalendar features
  • You can revoke access at any time through your Google Account settings

Changes to Integrations

We may add, modify, or remove third-party integrations at any time. If we remove a critical integration (like Google Calendar), we will notify you at least 30 days in advance (if possible), you may be entitled to a pro-rated refund, and we will provide guidance on exporting your data.

Third-Party Terms

Your use of third-party services through HomeCalendar is subject to those services' terms:

10. Intellectual Property

HomeCalendar Ownership

HomeCalendar and its licensors own all rights, title, and interest in:

  • The HomeCalendar application code, design, and user interface
  • The HomeCalendar name, logo, and branding
  • All documentation, marketing materials, and content we create
  • Patents, copyrights, trademarks, and trade secrets related to the Service

Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use HomeCalendar for personal, non-commercial family use
  • View and interact with the Service through a web browser
  • Store data on our servers as part of normal Service use

This license does not include the right to:

  • Modify, copy, or create derivative works of the Service
  • Sell, license, or distribute the Service
  • Use HomeCalendar branding without our written consent
  • Access the Service through unauthorized means

Trademarks

"HomeCalendar," "webettermove.com," and associated logos are trademarks of HomeCalendar. You may not use our trademarks without written permission.

11. Disclaimers and Limitations of Liability

Service Provided "As Is"

HOMECALENDAR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties including, but not limited to:

  • Merchantability: The Service will meet your specific needs
  • Fitness for a particular purpose: The Service is suitable for your intended use
  • Non-infringement: The Service does not infringe on third-party rights
  • Accuracy: All information in the Service is accurate and error-free
  • Availability: The Service will be available without interruption

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • No consequential damages: HomeCalendar is not liable for indirect, incidental, special, consequential, or punitive damages
  • No lost profits: We are not liable for lost profits, data loss, or business interruption
  • Maximum liability: Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim

Acknowledgment of Risk

You acknowledge that:

  • Calendar sync may occasionally have delays or errors
  • The Service depends on third-party services (Google, AWS) that we do not control
  • Technical issues may temporarily affect Service availability

12. Indemnification

You agree to indemnify, defend, and hold harmless HomeCalendar and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Content you create or share through the Service
  • Actions of family members you invite to your HomeCalendar

13. Termination

Termination by You

You may terminate your account at any time by:

  1. Canceling your subscription (if applicable)
  2. Deleting your account in Settings > Account > Delete Account

Termination by HomeCalendar

We may suspend or terminate your account if:

  • You violate these Terms
  • You fail to pay subscription fees
  • Your use poses a security risk
  • We are required to do so by law
  • We discontinue the Service

Notice: Except in cases of serious violations or legal requirements, we will provide at least 14 days' notice before terminating your account.

Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • You lose access to your HomeCalendar data
  • We may delete your data after 30 days (subject to legal retention requirements)
  • Provisions of these Terms that should survive will continue to apply

Data After Termination

  • 30-day grace period: You may reactivate your account within 30 days to recover your data
  • After 30 days: Your data is scheduled for permanent deletion
  • Export: You may request a data export before termination by contacting support@webettermove.com

14. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution

Before filing a formal dispute, you agree to contact us at support@webettermove.com to attempt to resolve the dispute informally. We will try to resolve disputes within 30 days.

Arbitration Agreement

BY AGREEING TO THESE TERMS, YOU AGREE THAT MOST DISPUTES WILL BE RESOLVED THROUGH BINDING ARBITRATION RATHER THAN IN COURT.

  • Arbitration provider: American Arbitration Association (AAA)
  • Arbitration rules: Consumer Arbitration Rules
  • Location: Arbitration will be conducted in your county of residence or remotely
  • Costs: We will pay all arbitration fees for claims under $10,000

Exceptions to Arbitration

You may bring claims in small claims court if eligible. Either party may seek injunctive relief in court to prevent irreparable harm.

Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

Opt-Out of Arbitration

You may opt out of the arbitration agreement by sending written notice to support@webettermove.com within 30 days of first accepting these Terms. Your notice must include your name, email, and a clear statement that you opt out.

15. Changes to Terms

How We Update Terms

We may modify these Terms at any time. When we make changes:

  1. Update the date: We will update the "Last Updated" date at the top
  2. Notify you: We will notify you via email and/or in-app notification
  3. Notice period: Significant changes will have at least 30 days' notice before taking effect

Your Acceptance

Your continued use of HomeCalendar after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms:

  • You must stop using the Service
  • You may delete your account
  • You may be entitled to a pro-rated refund (for annual subscribers)

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeCalendar regarding the Service.

Severability

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.

No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision in the future.

Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights to a successor in interest (e.g., in a merger or acquisition).

Force Majeure

HomeCalendar is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, strikes, government actions, or failures of third-party services.

  • Email to the address on your account
  • In-app notifications
  • Prominent posting on our website
